The petitioners challenge the registration of the FIR for offences punishable under Sections 316(2), 318(2), 318(4), 319(2), 61, 352, 351(2), and 3(5) of the BNS, 2023. 2. The 2nd respondent lodged the impugned FIR stating that the petitioners, along with other accused persons, induced the complainant to part with money by promising to secure a Government job. However, the accused neither secured the job nor returned the money, thereby acting with an intention to defraud. Prima facie, the allegations made in the FIR disclose the commission of cognizable offences, and the veracity of the allegations requires - 3 - NC: 2025:KHC:15667 CRL.P No. 321 of 2025 investigation, which cannot be assessed at this stage. 3. The petition stands disposed of, directing the first respondent to proceed with the investigation in accordance with law. However, no coercive action shall be taken against the petitioners. 4. The petitioners shall cooperate with the investigation and shall not be summoned without following due process of law. 5.
