02/09.06.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of Bharatiya Nagrik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in connection with Fatehpur PS Case No. 10 of 2025, for the offences punishable under sections 115(2), 126(2), 74 of BNS (323/341/354 of IPC) and 25(1-B) (a)/26 of Arms Act, pending in the court of learned SDJM, Jamtara.
2. Heard the learned counsel for the petitioner and the learned counsel for the State.
3. The learned counsel for the petitioner submits that no offence is made out against the petitioner. He further submits that even if the case of molestation is taken to be correct, the same is bailable. No arms have been recovered from the possession of the petitioner as the same was produced by Varun Mandal and Ashutosh Mandal.
4. The learned counsel for the State has opposed the prayer for anticipatory bail of the petitioner.
5. After going through the FIR and the impugned order, I find that the petitioner was trying to outrage the modesty of the informant on the pretext of applying colour upon her. She protested and when her brother-in-law came to save her, this petitioner taken out country made pistol. He was confronted and the weapon was also snatched from him.
6. Considering the nature of allegations, I do not find this case fit for grant of anticipatory bail.
7. Therefore, the present anticipatory bail application is dismissed.
