Heard learned counsel for the parties and perused the record. 2. The present petition has been filed by the petitioner with the following prayer: "Issue a writ, order or direction in the nature of MANDAMUS thereby commanding the opp. party no. 1 to 3 to remove the illegal encroachment of encroacher/opposite party nos. 4 to 8 from the Rasta/Navin Parti bearing land Gata No. 4421/0.190 hectare situated at village Raibigo, Tehsil Kadipur, District Sultanpur with immediate effect, because the said rasta/land is the sole way for coming and going to the house of the petitioner." 3. Learned Standing Counsel based upon instructions states that the proceedings under Section 67 of the U.P. Revenue Code have been initiated and are pending. 4. In view of the said statement, the present petition is disposed of with direction to conclude the said proceedings within 90 days in accordance with law.
