Neutral Citation No. - 2025:AHC-LKO:17935-DB Court No. - 2 Case :- WRIT - C No. - 3046 of 2025 Petitioner :- Mohd. Shakeel @ Shakeel Ahmad Respondent :- Mohd. Nasir And 16 Others Counsel for Petitioner :- Mayur Gautam,Ashuja Gupta Counsel for Respondent :- C.S.C.,Umesh Singh Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. Be means of this writ petition the petitioner has, inter alia, prayed for setting aside/declaring nullity the order dated 02.08.2021 passed in Writ-B No. 27732 of 2016, which has been taken by the respondents by playing fraud with the Hon'ble High Court. The petitioner alleges filing of the aforesaid petition in his name fraudulently and also that it was subsequently got dismissed as withdrawn on the ground of some alleged compromise having been arrived at between the parties, which again, according to him, was a fraudulent act, as no such compromise was entered into nor any application for withdrawal was filed by the petitioner. If it is so, then the remedy is not to file a separate writ petition, but to seek recall of the said order and then seek dismissal of the writ petition on the grounds aforesaid. At this stage, learned counsel for the petitioner says that he may be permitted to withdraw the writ petition, with liberty to pursue the said remedy. The writ petition is dismissed as withdrawn with the aforesaid liberty. (Om Prakash Shukla, J.) (Rajan Roy, J.)
