Petitioner is aggrieved by interference by official opposite parties in a private dispute. Petitioner claims to be owner of Gata No.1352 situated at Village-Aswa, Mohammadpur, Tehsil- Nanpara, District-Bahraich. The private opposite parties have their lands adjacent to the petitioner's Gata. 3. Learned Standing Counsel says that there is private dispute on account of which the police interfered for maintaining law and order. He also says that there is encroachment on Gata No.1351 which is recorded as road. 4. Be that as it may, the petitioner should initiate proceedings for demarcation of his Gata bearing Gata No.1352 and once the boundaries are demarcated then if any interference is made by any person he can take remedial measures. So far as police authorities are concerned they can interfere in such matters only if there is a law and order problem, apprehension of breach of peace, apprehension of commission of any crime or it has actually been committed or there is order of any court to be complied or there are other valid grounds in any law/statue for their interference. So far as revenue authorities are concerned they are free to get the boundary of the respective gatas demarcated as per law. In addition to it, it is open for the petitioner to avail other remedies including civil, revenue or criminal. 5. Accordingly, the petition is disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.)
