GP FOR REVENUE The Court made the following ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue an appropriate Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 to 4 in directing the petitioner to evict from the lands to an extent of Ac.1.95 Cents in S.No.323-2A and Ac.1.95 Cents in S.No.323-3A of Chippili Revenue Village, Madanapalle Mandal, Annamayya District pending disposal of the appeal Roc.NBI/3903/2020 before the 3RD respondent as illegal improper unjust arbitrary contrary to law and violation of Principles of Natural Justice and further direct the respondents not to evict the petitioner from the above propertyand pass such other order. 2 2. Heard the learned counsel for the petitioners and the learned Government Pleader for the respondents. 3. The learned counsel for the petitioner submits that the petitioner preferred an ROR appeal in Roc. No. NB1/3903/2020 before the 3rd respondent. Pending the said appeal, the staff of the 4th respondent are trying to interfere with the petitioner’s peaceful possession and enjoyment of the property and damaging the crops and structures on the property and to evict the petitioner from the subject land, without following the due process of law as contemplated under the Act. Hence, the present Writ Petition. 4. The learned Assistant Government Pleader for Revenue appearing for the respondents submits that the respondents authorities will consider the appeal vide Roc.NB1/3903/2020 and pass appropriate orders in accordance with law, within a reasonable time. 5. Having regard to the submissions made by the learned counsel for the petitioner and the learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered opinion that the present Writ Petition can be disposed of by directing the respondents’ authorities to dispose of the appeal in Rco.NB1/3903/2020, within a period of three(3) months from the date of receipt of copy of this Order. Till then, status-quo 3 obtaining as on today in respect of the subject property shall be maintained by all the parties concerned. 6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
