Present case has been preferred under Section 482 Cr.P.C./528 B.N.S.S. with the following main relief:- "i. Set aside the impugned cognizance/summoning order dated 19.12.2024 by the learned Court of Judicial Magistrate (Second), Sitapur in Sessions Case No. 0333/2024 State of U.P. Vs. Parmanand and others arising out of case crime no. 333 of 2024 under Sections 325 of B.N.S. 2023, Section 11 of the Prevention of Cruelty to Animals Act, 1960 Section 3, 5, 8 of the U.P. Prevention of Cow Slaughter Act, 1995 registered at Police Station Mahmoodabad District Sitapur as contained in Annexure no. 1 to this petition. ii. Quash the charge-sheet dated filed against the applicant/petitioner in Sessions Case No. 1231 of 2025, State of Uttar Pradesh versus Parmanand and others as well as entire trial proceedings pending before the learned Judicial Magistrate (Second) P.C. Act No. 7Lucknow so far as it relates to the applicant/petitioner as contained in Annexure no. 2 " After arguing at some length, learned counsel for the applicant has submitted that the applicant does not want to press the present case as such, it may be dismissed as not pressed with liberty to move a discharge application before the Court concerned. As such, the present application is dismissed as not pressed with liberty to the applicant to move discharge application before the court concerned. If any such application is preferred, the same shall be decided expeditiously, in accordance with law, if there is no any other legal impediment.
