It is submitted that no recovery has been effected from the petitioner and as per recovery memo, recovery was made by co-accused Asad Khan and on the basis of pending case, his bail application was rejected by the trial Court. The accused-petitioner is in custody since 21.02.2025, charge-sheet has been filed and offences are triable by Magistrate and conclusion of the trial will take long time, hence the petitioner may be enlarged on bail. 3. Taking into consideration the overall facts and circumstances of the case and the arguments advanced by counsel for both the parties, charge-sheet has been filed and the offences are triable by Magistrate, petitioner is in custody since 21.02.2025, without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, this bail application is allowed and accused- petitioner Monu Alias Mukesh @ Kachera S/o Late Shri Rajendra Kachera is ordered to be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so. 6. However, looking to the past history of the petitioner, it is made clear that the petitioner shall not involve in similar offence(s) during currency of the bail granted by this Court. The petitioner is further directed to mark his presence in the concerned Police Station in the 1st week of every month, till trial is concluded. If breach of any of these conditions, is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to petitioner by this Court.
