Neutral Citation No. - 2025:AHC-LKO:20296 Court No. - 18 Case :- WRIT - A No. - 3092 of 2025 Petitioner :- Atul Awasthi Respondent :- State Of U.P. Through Director General, Medical Education, Lucknow And 2 Others Counsel for Petitioner :- Durgesh Kumar Shukla,Naveen Awasthi Counsel for Respondent :- C.S.C.,Abhinav Trivedi Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner(s) and learned Standing Counsel who has accepted notice on behalf of respondents No.1 as well as Mr. Shubham Tripathi, Advocate who appears for respondents 2 and 3. Mr. Tripathi undertakes that he will file vakalatnama in the Registry. By means of this writ petition, the petitioner has prayed for issuance of a writ of mandamus directing respondents to extend dates for filling online application for recruitment released vide notice dated 22.10.2024, with a further direction not to start selection process before clarification of new dates.
Learned counsel for the petitioner submits that an advertisement for recruitment on Group B and C posts was published on 22.10.2024. On 22.11.2024, the brochure was released and as per advertisement, although the last date for applying the post was 31.12.2024, however, it has been extended on various dates. It is submitted that the respondents will start the selection process without giving new dates.
Learned counsel for respondents 2 and 3 on the basis of written instructions submits that the last date to apply for the post was 31.12.2024. It was extended till 31.1.2025 and then till 3.3.2025. He
has denied that the dates have been extended till
15.3.2025. It is next submitted that the petition has been filed while pleading incorrect facts and on the basis of apprehension. After 3.3.2025, no fresh date has been extended. Only those candidates who have applied have been given three days time to pay fee etc. From the written instructions which are taken on record, it is apparent that the apprehension of the petitioner that new dates are being given for filling up the form is mis-conceived. The averment in the petition that now 15.3.2025 has been fixed as extended date is also false as per the written instructions. In view of the above, the petition fails and is accordingly dismissed.
