The petitioner herein challenges recovery proceedings, however, on being confronted with factual and legal aspects, he submits that he is ready to pay the same in reasonable installments. Learned counsel for the opp. party No. 2/Bank Sri Vinod Kumar Singh, Advocate, has no objection, however, he informs that as on 24.3.2025 the amount due to be paid by the petitioner is Rs. 3,66,070.00. In view of the above, this writ petition is disposed of with the following directions: (1) The petitioner shall deposit an amount of Rs. 50,000.00 (Rupees Fifty Thousand only) within one month and the remaining amount shall be deposited by him in 6 equal quarterly installments. The last installment shall include the residuary amount also. (2) If the petitioner defaults in payment of any of the installments, as aforesaid, the benefit of this order shall not be available to him and it shall be open for the opp. party to proceed to recover the due amount as per law.
