According to petitioner, he was appointed as Peon in an unaided recognised Junior High School in the year 1998 and he is serving continuously against said post till today. 3. The said institution was taken in the grant- in-aid list of the State Government vide G.O. dated 27.02.2014; however, in that G.O. there was no provision for regular Peon although other teaching and non-teaching posts were created. 4. Learned State Counsel submits that said Government Order provides that Peon shall be engaged through outsource agency in view of the decision taken by State Government to declare Group-D posts as dying cadre. 5. Learned counsel for the petitioner submits that all other teaching and non teaching employees, who were serving in the institution in question before issuance of Government Order, have been appointed against post sanctioned by the State Government and they 2025:UHC:8443 have been paid salary from the public exchequer; however, petitioner is denied of similar treatment. This, learned counsel for the petitioner submits that is violative of equality clause. 6. Learned State Counsel submits that petitioner has sought a writ of mandamus without making a formal demand. He submits that if petitioner makes a demand by making representation, the same shall be considered as per law. 7. Accordingly, writ petition is disposed of by permitting petitioner to make representation. If he makes such representation within two weeks from today, decision thereupon shall be taken by competent authority within four months thereafter.
