The aforesaid case has been registered on the basis of an F.I.R. lodged on 14.01.2025 on the basis of an application under Section 156 (3) Cr.P.C. filed against four persons including the applicant, stating that the informant resides in a rented accommodation in a house and the applicant also used to reside in a separate portion in the same house; that the applicant had prepared an obscene video of the informant and by threatening to spread that video viral, he forced the informant to make physical relations with him. The informant further stated that the applicant had forwarded the obscene video to some other persons. The applicant pressurized and persuaded the informant to elope with him and she went with him while taking away Rs.2,50,000/- in cash and jewellery of worth Rs.3,50,000/-, but, thereafter, the applicant left the informant. 4. In the affidavit filed in support of bail application it has been stated that the applicant is innocent, he has been falsely implicated in the present case and he has no criminal history. 5. The learned A.G.A. has opposed the prayer for bail application on the basis of instructions provided to him. However, the instructions are silent upon recovery of any obscene video. 6.
Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the informant is a matured lady aged 33 years; that although the informant has alleged blackmailing on the strength of obscene video, she could not provide any material in support of this allegation; that the applicant has no previous criminal history and he is languishing in jail since 22.01.2025 and the investigation already stands concluded and the charge sheet has been submitted on 11.03.2025 and without making any observation, which may affect the merits of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime. 7.
