This petition has been filed for the following main reliefs:- "(i) Issue a writ, order, or direction in the nature of certiorari to quash the order dated 30.12.2024 passed by the opposite party no.1/ District Magistrate, Barabanki in Suit No. 3024/2024, Computerized Case No.: D202404120003024 (Vivek Chandra Sharma & others Vs. Kamlesh & others) contained as Annexure No.1 to this writ petition, in the interest of justice. (ii) Issue a writ, order, or direction in the nature of Mandamus commanding the opposite party no.1 to collect all these cases at one place and please order to collect them in one court." 3. Vide impugned order dated 30.12.2024 passed on application preferred under Section 225(Cha) of U.P. Revenue Code, 2006 (in short 'Code 2006'), registered as Case No.3024 of 2024; Computerized CAse No.D202404120003024, the Collector/District Magistrate, Barabanki -opposite party no.1 has refused to grant the prayer of the petitioners for consolidating the Case No.20220412025740 pending before Sub-Divisional Magistrate, Nawabganj, Barabanki and Case No.2022041201270006 pending before Sub-Divisional Magistrate, Judicial, Nawabganj, Barabanki and Case No.20220412025740 pending before Additional Officer, Nawabganj, Barabanki, all instituted under Section 116 of Code 2006. The operative portion of order dated 30.12.2024 reads as under. "पतत्रावलली प्रस्ततुत। पतुकत्रार करत्रायली गयली। वत्रादली /प्रत्रारर्थी अनतुपसस्रत। ववपकली कके ववदत्रान अधधिवकत्रा सवहित शत्रासककीय अधधिवकत्रा (रत्राजस्व) कके तकर्को कको सतुनत्रा गयत्रा। ममैनन ववपकली कके ववदत्रान अधधिवकत्रा सवहित शत्रासककीय अधधिवकत्रा (रत्राजस्व) दत्रारत्रा प्रस्ततुत तकर्कोर कके पररप्रकेक्ष्य मन समकेकन पतत्रावलली सवहित अवर न्यत्रायत्रालय सके प्रत्राप्त पतत्रावधलययों कत्रा सम्यकक अवलकोकन एवर पररशलीलन वकयत्रा। समकेकन पतत्रावलली पर उपलब्धि तत्रामलीलत्रा आख्यत्रानतुसत्रार ववपकली सरख्यत्रा -06 बधलरत्राज पतुत छत्रारगतुर, ववपकली सरख्यत्रा-19 शलीमतली पतुष्पत्रा पत्नली रत्राम समतुझ व ववपकली सरख्यत्रा-22 चन्द्रबलली पतुत रत्राम स्वरूप ममृतक हिमै। ऐसली दशत्रा मन समकेकन प्रत्राररनत्रा पत पर वतरमत्रान मन ववचत्रार वकयके जत्रानके यकोग्य नहिली हिमै। पककत्रार वत्राद कके सरचत्रालन हिकेततु उक ममृतकयों कके सम्बन्धि मन अवर न्यत्रायत्रालय कके समक ववधधि अनतुसत्रार कत्रायम मतुकत्राम प्रत्राररनत्रा पत प्रस्ततुत कर उनकके प्रवतस्रत्रानली कको प्रवतस्रत्रावपत करत्रानके कके उपरत्रान्त पतुननः समकेकन प्रत्राररनत्रा पत प्रस्ततुत कर सकतके हिमै। अतनः वत्रादली/प्रत्रारर्थी वववकेकचन्द्र शमत्रार पतुत स्व० जत्रानचन्द्र शमत्रार व कतु ० पतुष्पत्रा पतुतली स्व० जत्रानचन्द्र शमत्रार वनवत्रासलीगण गत्राम अतररौलली परगनत्रा सतररख तहिसलील नवत्राबगरज धजलत्रा बत्रारत्राबरककी दत्रारत्रा प्रस्ततुत समकेकन प्रत्राररनत्रा पत वदनत्रारवकत 18.09.2024 बधलरत्राज, शलीमतली पतुष्पत्रा व चन्द्रबलली कके ममृतक हिकोनन कके कत्रारण वनरस्त वकयत्रा जत्रातत्रा हिमै। सम्बसन्धित अवर न्यत्रायत्रालय ककी पतत्रावधलयत्रार आदकेश ककी प्रमत्रावणत प्रवत कके सत्रार वत्रापस प्रकेवषित ककी जत्राय। बत्राद आवश्यक कत्रायरवत्राहिली समकेकन पतत्रावलली सरवचत रत्राजस्व अवभिलकेखत्रागत्रार ककी जत्राय (सत्यकेन्द्र कतु मत्रार) कलकेक्टर/धजलत्राधधिकत्रारली, बत्रारत्राबरककी।" 4. Upon due consideration of the facts of the case as also the observations made in the impugned order by the opposite party no.1 as also the submissions advanced before this Court by learned counsel for the petitioners and learned Counsel for the State Shri Badrish Tripathi, this Court finds that no interference in the impugned order is required. It is for the following reasons:- (i) The application under Section 225(CH) of Code 2006 was filed against the dead persons namely Baliraj s/o Changur, Smt. Pushpa w/o Ram Samujh and Chandrabali s/o Ram Swaroop. (ii) The opposite party no.1 has provided the opportunity to the petitioners to prefer an application for consolidation of cases after substitution of the legal heirs of the persons named above. 5.
