Neutral Citation No. - 2025:AHC-LKO:16861-DB Court No. - 2 Case :- WRIT - C No. - 2752 of 2025 Petitioner :- Chob Singh And Co. Engineers And Contractors Thru. Partner Sri Pramod Kumar And 2 Others Respondent :- U.O.I. Ministry Of Defence Deptt. Of Defence Central Secrett. Thru. Defence Secy. And 3 Others Counsel for Petitioner :- Rakesh Srivsatava,Sudama Prasad Counsel for Respondent :- A.S.G.I. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. The petitioners claim to be partners in a partnership firm, of which, according to them, opposite party No.4 was also a partner, but he resigned/retired. Now the opposite party No.4 disputes this fact as is mentioned in annexure No.1 that is why the official opposite parties have communicated to the petitioners to get the dispute pertaining to the firm resolved, otherwise it will not be treated as an enlisted firm. The firm was engaged in supplying of material and construction work etc. to the official opposite parties. We see no infirmity in the order and we cannot go into this dispute as to whether the opposite party No.4 has resigned validly or not. It is not disputed by the petitioners' counsel that the opposite party No.4 has subsequently submitted a complaint to the opposite parties saying that he has not retired. Such disputes are not amenable to writ jurisdiction as they are between the partners and relate to a partnership firm. The Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.)
