The petitioners have been made accused in connection with Garhwa P.S. Case No.689 of 2024 registered for the offences punishable under Section 310(2) of the B.N.S., 2023. Learned counsel for the petitioners submit that the allegation against the petitioners is that the petitioners were involved in committing dacoity along with 6 other persons. It is submitted that the allegation against the petitioners is false. It is next submitted that the petitioners have been implicated only on the basis of the confessional statement of the co-accused person. It is next submitted that the petitioners were not put on TI Parade but still charge sheet has been submitted against them. It is next submitted that the petitioners undertake that they will co-operate with the trial of the case. It is lastly submitted that the petitioners have been in custody since 26.12.2024 as is evident from para-09 of the instant bail application. Hence it is submitted that the petitioners be released on bail. Learned Addl.P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties each of the like amount each to the satisfaction of learned C.J.M., Garhwa in connection with Garhwa P.S. Case No.689 of 2024 with the condition that they will co- operate with the trial of the case and furnish their mobile numbers and photocopy of the Aadhar Cards in the court below with an undertaking that they will not change their mobile numbers during the trial of the case.
