Neutral Citation No. - 2025:AHC-LKO:16382-DB Court No. - 2 Case :- WRIT - C No. - 2749 of 2025 Petitioner :- Mijjan Khan Respondent :- State Of U.P. Thru. Prin. Secy. Urban Development Lko And 3 Others Counsel for Petitioner :- Mohd. Hayan Hasan Counsel for Respondent :- C.S.C.,Rakesh Pratap Singh Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. 1. Heard. 2. The petitioner claims certain dues from the Nagar Palika Parishad, District-Bahraich for alleged work done in the year 2022-23. The amount claimed is about Rs.12,64,972/- based on 17 pending bills, however, from Annexure No.9, it appears that the original work etc., are not available and there is no agreement on record. We have also seen Annexure No.1, which are certain documents, which according to the petitioner corroborate his claim, however, this may involve a factual inquiry requiring evidence, therefore, a writ petition is not the appropriate remedy, petitioner may avail other remedies. It is also open for the petitioner to approach the authorities making out a claim for payment of dues. As regard the order dated 08.03.2019 passed in Civil Appeal No.2610 of 2018 (Arising out of SLP (C) No.29505 of 2014) it was a case of admitted liability, which does not appear to be the case here. 3. With the aforesaid observations, the writ petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
