Neutral Citation No. - 2025:AHC-LKO:16435 Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 1518 of 2025 Petitioner :- Smt. Hitraji Respondent :- Smt. Reeta Counsel for Petitioner :- Angrej Nath Shukla Hon'ble Pankaj Bhatia,J. 1. Heard learned counsel for the petitioner. 2. The present petition has been filed challenging the order, whereby the injunction was refused and the order passed in appeal, whereby the appeal was dismissed. 3. In the two orders, it was recorded that the petitioner could not establish the prima facie case. 4. No injunction is required at this stage, however, in view of the doctrine of lis pendens, I do not see any reason to pass any order as prayed by learned counsel for the petitioner. 5. Considering the two findings of fact recorded, prima facie there is no reason for this Court to interfere with the said orders. However, as the suit is of the year 2016, the trial court shall endeavour and decide the suit expeditiously, preferably within a period of one year from today, in accordance with law. 6. The petition stands disposed of. Order Date :- 21.3.2025 Ashutosh Digitally signed by :- ASHUTOSH PANDEY High Court of Judicature at Allahabad, Lucknow Bench
