Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in C.C. No.1855 of 2023 on the file of the Court of the IV Additional Chief Metropolitan Magistrate, Vijayawada, for the alleged offence under Section 324 of the Indian penal Code, 1860. 3. The learned counsel further submits that the petitioner is the brother-in-law of the 2nd respondent and that on account of marital disputes, the petitioner was falsely implicated in C.C. No.1855 of 2023. 4. Considering the relationship between the petitioner and the 2nd respondent and also considering the submissions of the learned counsel for the petitioner, the presence of the petitioner in C.C. No.1855 of 2023 pending before the IV Additional Chief Metropolitan Magistrate, Vijayawada, is hereby dispensed with, subject to submitting an undertaking to the learned Magistrate, to appear as and when directed and required for the purpose of trial. 3 5.
