Sri Rahul Shukla learned Additional Chief Standing counsel has raised preliminary objection regarding maintainability of the petition on the ground that even though the petitioner may not have been appropriately described in the arrays of parties but nevertheless the petitioner has assailed merely a consequential order which has been brought on record Annexure no.1 without challenging the notification dated 08.12.2023. A copy of the same has been provided by the Additional Chief Standing counsel for the perusal of the Court which is taken on record. It has further been urged that even the letter which has been assailed has not been addressed to the petitioner and it is purely an inter department notification. For the aforesaid reasons, the petition is not maintainable. Sri K.K. Sharma learned counsel, at this stage, submits that he may be permitted to withdraw the present petition with liberty to file fresh as he wishes to assail the notification dated 08.12.2023.
