Review Application MCC No. 04 of 2025 In WPMB No. 538 of 2024
Hon’ble G. Narendar, C.J. Hon’ble Alok Mahra, J.
1. Mr. Rajendra Singh Azad, learned counsel for the petitioner through video conferencing.
2. Mr. J.C. Pande, learned Standing Counsel for the State of Uttarakhand.
3. Mr. S.S. Chauhan, learned counsel for respondent Nos. 2 to 4.
4. Mr. T.A. Khan, learned Senior Counsel assisted by Mr. Vinay Bhatt, learned counsel for respondent No. 5 / review applicant.
5. The review application is against an order permitting the withdrawal of the writ petition. Review is to be premised on an error apparent on the face of the record. An application for withdrawal was made and the same has been permitted. The petitioner is the master of his petition, and if the petitioner desires to withdraw
and that too without reserving any liberty or any concession, the question of maintainability of the review petition is to be looked into.
6. In the absence of any error apparent on the face of record, the review application, in our considered opinion, is highly misconceived. It is accordingly, rejected. The observations herein will not come in the way of the consideration of the pending petition.
