P.P. …...... 03/13.06.2025: The petitioner is praying for grant of bail as he is in custody for allegedly committing offence punishable under Sections 304(B)/34 of IPC and charged for under Section 304(B) r/w 34 of IPC and Section 302 r/w 34 of IPC, in connection with Mohammadganj Police Station Case No.31 of 2017, corresponding to G.R. No.1764 of 2017 (S.T. Case No.366 of 2017), pending in the Court of learned Additional Sessions Judge-V, Palamau at Daltonganj. 2. Petitioner renewed his prayer for bail as he is in custody from 13.08.2017 i.e. for more than 7 and ½ years. Petitioner is in custody during trial, and the trial has not yet been concluded. 3. Considering the delay in the trial which can be attributed to the prosecution and also considering the period of custody, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Palamau at Daltonganj in connection with Mohammadganj Police Station Case No.31 of 2017, corresponding to G.R. No.1764 of 2017 (S.T. Case No.366 of 2017) subject to the following conditions:- (i) One of the bailors should be a close relative of the petitioner, having sufficient landed property in his own name in the State of Jharkhand; (ii) The petitioner will appear and mark his attendance before the Judge-in-Charge, Palamau at Daltonganj once in a month till completion of the trial. If he fails to appear in any particular period, his bail bonds shall stand cancelled and steps should be taken to arrest the petitioner. (ANANDA SEN, J.) R.S./
