Tiwari, learned AGA that this petition is not maintainable as the appeal filed by the petitioner against the judgement and order passed by the trial court convicting the petitioner by means of the judgment and order dated 27.07.2022 passed in Criminal Case No.860 of 2017(State versus Ezaz and others) by the Chief Judicial Magistrate, Faizabad is pending before the appellate court and any grievance raised in this petition can be raised in that appeal itself, Sri Indra Kumar Yadav, learned counsel for the petitioner submits that the petitioner had moved an application raising his grievance but the same has been rejected by means of the order dated 08.10.2024, therefore, this petition may be dismissed as not pressed with liberty to avail appropriate remedy as may be available under law against the said order. To which there is no objection by learned AGA. Dismissed as not pressed with liberty as aforesaid.
