Neutral Citation No. - 2025:AHC-LKO:16402-DB Court No. - 2 Case :- WRIT - C No. - 2732 of 2025 Petitioner :- M/S Rajshree Enterprises Thru. Proprietor Amiata Dhaka And Another Respondent :- State Of U.P. Thru. Special Secy. Deptt. Of Geology And Mining Lko. And 2 Others Counsel for Petitioner :- Rahul Srivastava Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. An application for interim relief filed by the petitioners before the revisional authority has been rejected. The relief sought was for restraining the opposite parties from creating third party rights, meaning thereby, the mining area be not settled with any other person. We are of the opinion that whatever settlement is made during pendency of the revision, the same would be subject to the result of the revision, meaning thereby, if the revision succeeds, then obviously such settlement will go, however, if it fails then the matter would rest as it is, unless of course there is any other option available in law. With this clarification, we dispose of this Writ Petition specially as revision is fixed for final hearing on 26.03.2025 and we have no reason to believe that the same would not be decided at the earliest say within six weeks.
