Neutral Citation No. - 2025:AHC-LKO:18555-DB Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 293 of 2025 Petitioner :- Shri Tulsi Janmabhumi Nyas Thru. President Dr. Swami Bhagwadacharya And Another Respondent :- State Of U.P. Thru. Chief Secy. Lko. And 3 Others Counsel for Petitioner :- Suneel Kumar Singh Kalhans,Pallavi Singh,Shikha Srivastava Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent. A writ petition seeking similar relief was previously instituted before this Court i.e. PIL No.692 of 2023 (Dr. Shailendranath Mishra vs. Union of India and others). This Court while rejecting the said writ petition has passed the following order:-
"1. This petition under Article 226 of the Constitution of India instituted by way of Public Interest Litigation involves purely a question which is essentially academic in nature.
2. The petitioner himself is uncertain about the real date of birth for which the relief has been prayed for.
3. The reliance placed upon by the petitioner upon any text book having no legal sanctity cannot lead us to opine one way or the other
4. Such questions are left open for declaration if the petitioner is so aggrieved.
5. The writ petition being misconceived is accordingly dismissed without prejudice to the remedy of declaration sought if any." The prayer made herein for a direction to the State or
constituting a commission is virtually for serving no purpose but an academic interest. For such a purpose, this Court has already declined to intervene in the previous writ petition. The present writ petition is also declined to be entertained and the same is consigned to record. . (Karunesh Singh Pawar, J.) (Attau Rahman Masoodi, J.)
