By means of the instant petition, the petitioner has sought directions to the respondent nos.3 and 4 to search the file of Mutation Case No.30/490 of 1999-2000, Jagtar Singh Vs. Mallu Singh, decided by the court of Naib Tehsildar, Jaspur, Tehsil Kashipur, District Udahm Singh Nagar on 16.09.2000 (“the case”). The petitioner has also sought directions that legal action be taken against the officer, who has lost the record of the case. Heard learned counsel for the parties and perused the record. It is the case of the petitioner that he is not getting the details of the case. Therefore, the petition has been filed. On the last occasion, the Court has required learned State Counsel to get instructions, as to whether the record of the case was weeded out and under what provision of law, it has been done? Learned State Counsel has placed for perusal of the Court the instructions, which he received. He submits that as per instructions, in accordance with the Government Order, the record of the case has been weeded out on 25.04.2005. The instructions are taken on record. At it, learned counsel for the petitioner would submit that he may be given permission to withdraw the petition with the liberty to seek appropriate relief before the appropriate forum. The permission is accorded. The petition is dismissed as withdrawn with the aforesaid liberty.
