Neutral Citation No. - 2025:AHC-LKO:16787-DB Court No. - 2 Case :- WRIT - C No. - 2725 of 2025 Petitioner :- Om Chandra Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 3 Others Counsel for Petitioner :- Mithlesh Singh Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. After hearing the parties what comes out is that there is a dispute as to the situation of eucalyptus trees, which the petitioner claims to be his. Learned Standing Counsel for the Gram Sabha and the State submit that the trees are on Gata No.840 and 841 whereas the petitioner says that it is Gata No.838. The petitioner should avail the remedy as prescribed under Sections 56 and 58 of the Uttar Pradesh Revenue Code, 2006 or such other provisions of the Uttar Pradesh Revenue Code, 2006 as may be applicable. Counsel for the petitioner vehemently relied on an order dated 17.02.2023 passed in Writ C No.1278 of 2023, however, we find that in the said case, there was no dispute as regard the situation of the trees, therefore, the said order is not applicable in this case. The Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 24.3.2025 Saurabh Digitally signed by :- SAURABH VERMA High Court of Judicature at Allahabad, Lucknow Bench
