Heard learned counsel for the petitioner and learned Standing Counsel for State-respondents. By this petition, the petitioner has prayed for the following reliefs:- "1) To issue a writ, order or direction in the nature of Mandamus commanding and directing to the opposite parties to consider and grant promotion to the petitioner on the post of Group A, Level-II, Pay Band-3, pay scale of 15600-39100 and grade pay of Rs. 7600/-from date of juniors promotion along with all consequential service benefits including arrears of salary etc. 2) To issue a writ, order or direction in the nature of Mandamus commanding and directing to the opposite parties to ignore the effect of the punishment order dated 27.04.2015 and consider for grant notional promotion to the petitioner on the post of Group A, Level-II, Pay Band-3, pay scale of 15600-39100 and grade pay of Rs. 6600/-w.e.f. 30.06.2016 from date of juniors promotion thereafter to allow all consequential service benefits, including arrears of salary etc, in the interest of justice." After arguing for sometime, learned counsel for the petitioner confines his prayer to the extent that the representation of the petitioner dated 03.01.2025, which is on record as Annexure-9, may be directed to be decided by respondent no.2. Learned Standing Counsel has no objection to this innocuous prayer. Perused the record. Considering the above, the petition is disposed of with liberty to the petitioner to move a fresh representation to respondent no.2 i.e. Director, Technical Education, U.P. Kanpur within two weeks' from today. If the petitioner submits a fresh representation, the respondent no.2 shall decide the same within four weeks' thereafter, by passing a speaking and reasoned order.
