HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU SWP No.2098/2015 Mohd. Rafiq ..... Petitioner(s) Through :- None. Vs Union of India and others .....Respondent(s) Through :- Mr. Sumant Sudan, Assisting Counsel to Mr. Vishal Sharma, DSGI for R-1. Mr. Paramveer Singh, Advocate for R-2 to 4. Mrs. Monika Kohli, Sr. AAG for R-5 & 6. None for R-7. CORAM: HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 17.10.2025 The record reveals that none has appeared on behalf of the petitioner on 02.08.2022, 08.09.2022 and when the petition was listed before this Court on 02.12.2022, the learned counsel for the petitioner was confronted with the maintainability of the instant petition and was directed to address the issue with regard to the maintainability of the instant petition before proceeding further in the matter. When the petition was listed before this Court on 13.12.2023, Mr. Ranjit Singh, Advocate appearing vice Mr. Pawan Kumar Kundal, Advocate sought adjournment due to non-availability of the arguing counsel for the petitioner. Today, when the instant petition was taken up, there is no representation on behalf of the petitioner and thus an inference can be drawn that the petitioner is not interested in prosecuting the instant petition, more Sr. No. 175 2 SWP No.2098/2015 particularly, when the petitioner was confronted with the maintainability of the instant petition and was under an obligation to address the argument in this behalf. The writ petition is, accordingly, dismissed for non-prosecution. Interim direction, if any, shall stand vacated.
