Neutral Citation No. - 2025:AHC-LKO:15609 Court No. - 5 Case :- WRIT - C No. - 2671 of 2025 Petitioner :- Dr. Sushil Kumar Respondent :- State Of U.P. Thru. Prin. Secy. Medical Education, Lko. And 3 Others Counsel for Petitioner :- Hari Prasad Gupta,Bal Keshwar Srivastava,Sanju Pal Counsel for Respondent :- C.S.C.,Shubham Tripathi,Syed Mohammad Haider Rizv Hon'ble Abdul Moin,J. 1. Heard learned counsel for the petitioner, learned Standing Counsel appearing for respondent No.1, Shri Syed Mohammad Haider Rizvi, learned counsel appearing for respondent No.2 and Shri Shubham Tripathi, learned counsel appearing for respondent No.3 and 4. 2. The petitioner has prayed for quashing of the resignation slip dated 12.03.2025, a copy of which is Annexure-16 to the petition, and the seat matrix of NEET-P.G. Counseling, 2024 for M.D. General Medicine reserved for O.B.C. of K.G.M.U., Lucknow. 3. Bereft of unnecessary details facts of the case are that the petitioner claims to have secured admission after NEET Counseling in the King Georges Medical University i.e. respondent No.3-Institution for M.D. General Medicine. 4. Learned counsel for the petitioner states that on account of stress with which the petitioner was suffering from, he tendered his resignation on 12.03.2025 through his Resignation Letter, a copy of which is Annexure-15 to the petition, giving his intention to resign from the post/seat with effect from 13.03.2025. The resignation has been accepted on the same day itself. Thereafter, the seat has been thrown open for the next round of NEET Counseling special stay round. 5. As per Shri Syed Mohammad Haider Rizvi, learned counsel appearing for respondent No.2, 778 persons have applied for the seat, which was earlier held by the petitioner and the matrix has closed at 10 A.M. today itself i.e. 17.03.2025 and the result is under process. 6. Shri Shri Syed Mohammad Haider Rizvi, learned counsel appearing for respondent No.2, on the basis of instructions sent by respondent No.2, states that any permission that may be granted to the petitioner by this Court would result in total chaos inasmuch as 778 persons have already applied for the said seat perhaps after giving up other seats that might have been available consequently any interference in the matter would be rendering grave and extreme hardship to the aforesaid persons, who have applied in pursuance of the seat having been thrown open. 7. Considering the aforesaid scenario which has now emerged, the matrix having also been closed at 10:00 A.M. today itself and 778 persons having also applied for the said seat, accordingly nothing further can be done in the matter. 8. Keeping in view of the aforesaid discussion, it would not be in the interest of justice to interfere with the matter. The petition is dismissed.
