Neutral Citation No. - 2025:AHC-LKO:17504-DB Court No. - 1 Case :- SPECIAL APPEAL No. - 119 of 2025 Appellant :- Alpika Shukla Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Planning Lko. And 2 Others Counsel for Appellant :- Birendra Kumar Yadav,Satendra Jaiswal Counsel for Respondent :- C.S.C.,Gaurav Mehrotra Hon'ble Attau Rahman Masoodi,J. Hon'ble Ajai Kumar Srivastava-I,J.
1. Heard Sri B.K. Yadav, learned counsel for the appellant and Sri Prashast Puri, learned counsel for respondent no.3.
2. The present intra-court appeal under Chapter VIII, Rule 5 of the Allahabad High Court Rules, 1952, has arisen out of the judgment and order dated 17.02.2025, passed by the learned Single Judge in Writ A No. 12183 of 2024, whereby the claim set up by the petitioner/appellant for participation in the selection-in-question for recruitment to the post of A.R.O. has been turned down.
3. On a close scrutiny of the judgment impugned herein, it is amply clear that the appellant does not possess the requisite qualification as specified in the advertisement for the post-in-question. This fact could not be disputed by the appellant, nor is there any averment in the writ petition that he possessed the requisite qualification as prescribed in the advertisement, which stands in conformity
with the relevant service rules.
4. The reasoning assigned by the learned Single Judge regarding the ineligibility of the present appellant does not suffer from any perversity or illegality that may call for interference in the exercise of the appellate powers of this Court.
5. The intra-court appeal, bereft of any merit, is accordingly dismissed. (Ajai Kumar Srivastava-I, J) (Attau Rahman Masoodi, J) Order Date :- 27.3.2025 A.Dewal Digitally signed by :- ASHISH DEWAL High Court of Judicature at Allahabad, Lucknow Bench
