The petitioner has not preferred the instant petition against any particular order but preferred the same against the delay in VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.03.29 15:59:49 +0530 2 trial, that a Complaint Case has been filed on 04.10.2021 but till date the case has not been registered, that due to the delay in the proceeding the petitioner is facing mental and financial harassment. That the court has not registered the case without any sufficient reason. Copy of order sheet of Unregistered Criminal Case/2020 pending before the learned Judicial Magistrate First Class, Jaijaipur, Dist Janjgir- Champa (C.G.) 2. Brief facts of the case are that, during her pregnancy the respondent No. 01 was not happy and always used to complain that she is not interested to take the responsibility of motherhood and wanted to drop the pregnancy. That in furtherance of her ill intention she went to her parental house in the month of November 2016 along with her brother saying that she want to see her parents. The petitioner has filed a Complaint Case U/s 200 of Criminal Procedure Code for taking action against the cruel and illegal act of his wife respondent No. 01, his father-in-law respondent No. 02, his mother-in-law respondent No. 03 and brother-in-law respondent No. 04 whereby they have under a criminal conspiracy got the pregnancy of respondent No. 01 terminated without any medical necessity and without informing the petitioner. 3. Learned counsel for the petitioner submits that the learned trial Court erred in ignoring that the case is at the stage of complainant evidence before registration and the petitioner is ready to give the same but the case have been adjourned for one or another reason and has not proceeded further. He further 3 submits that the matter is pending since 2020, till date trial has not been concluded. He made a limited prayer to expedite the trial pending before the concerned trial Court. 4. To the limited prayer that the petitioner has made, is not opposed by the learned State Counsel. 5. Considering the submission made by the learned counsel for petitioner that statement of the complainant has been recorded before the trial Court and the proceeding is in progress and case is fixed for arguments before registration, therefore, the instant Cr.M.P is disposed of with a direction that the trial Court shall heard the arguments/matter before registration of case and pass the order as per law within a period of 30 days from the date of receipt of copy of this order, if there is no legal impediment. 6.
