Neutral Citation No. - 2025:AHC-LKO:8481 Court No. - 5 Case :- WRIT - A No. - 2293 of 2024 Petitioner :- Rajesh Singh Respondent :- State Of U.P. Thru. Addl. Chief Secy. Secondary Education Deptt. Lko. And 5 Others Counsel for Petitioner :- Mahendra Pratap Singh,Ranjit Singh Counsel for Respondent :- C.S.C.,Pradeep Kumar Singh Vats Hon'ble Abdul Moin,J. Heard learned counsel for the petitioner, Shri Piyush Kumar, learned Standing Counsel for the respondents no. 1 to 5 and Shri Vijay Kumar Singh, Advocate, holding brief of Shri Pradeep Kumar Singh Vats, learned counsel for the respondent no. 6. At the very outset, learned counsel for the petitioner states that he does not intend to press the writ petition so far as it pertains to prayer no. (i) and prays that the writ petition may be dismissed as withdrawn so far as it pertains to prayer no. (i). Learned counsels for the respondents have no objection to the aforesaid prayer. Accordingly, the writ petition is dismissed as not pressed so far as it pertains to the prayer no. (i). There is consensus at the Bar that so far as the order impugned in the instant petition is concerned, the same is squarely covered by the principle of law enunciated by this Court in a bunch of writ petitions leading being Writ A NO. 8517 of 2023 in re: Tirthraj vs State of U.P. and others decided on 17.05.2024. Considering the aforesaid consensus, the writ petition is allowed. The order impugned dated 30.01.2024, a copy of which is annexure 2 to the writ petition, passed by respondent no. 4 and issued by respondent no. 3 is quashed. The competent authority is directed to pass a fresh order in accordance with law and relevant rules considering the judgement of this Court in the case of Tirthraj (supra). Let such an order be passed within a period of six weeks from the date of receipt of a certified copy of this order. Order Date :- 10.2.2025 J. K.
