If the opposite party No.4 or its corporator is undertaking any construction of road on Gata No.106 sitauted in Village Ganeshpur Rahmanpur (Ismailganj Ward II), Pargana Tehsil and District Lucknow or any part of it without the said land having been acquired or purchased and if the petitioner is owner of the said land and there is no dispute in this regard, then the opposite party No.4 shall take immediate action so that the land of the petitioner, if it is so, is not encroached for the said purpose unless it is acquired or purchased as per law. We have not adjudicated the claim of the petitioner to be the owner of the said land, which may be got verified by the opposite party No.4. The Writ Petition stands disposed of.
