Neutral Citation No. - 2025:AHC-LKO:15779 Court No. - 18 Case :- WRIT - A No. - 3029 of 2025 Petitioner :- Vimla Devi Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Child Development/Nutrition Lko. And 6 Others Counsel for Petitioner :- Moti Lal Yadav Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Additional Chief Standing Counsel for respondent no. 1 to 6. Notice to respondent no. 7 is dispensed with in view of the proposed order. Through this petition, the petitioner has prayed for the following relief:- It is most respectfully prayed that this Hon'ble High Court may kindly be pleased to issue writ order or direction in the nature of mandamus directing the opposite party no. 3 and 4 to consider the appointment of the petitioner on top priority basis for the post of Anganwadi Kryakarti of Village Bhikharipur Kasba (Gadariyan Kheda) Post, Block, Tehsil - Bangarmau, District - Unnao as per column 3 clause X(ग) of the government
order dated 21-03-2023.
Learned counsel for the petitioner submits that, in light of the Government Order dated 21.03.2023 (Annexure No. 1), as per clause ग-III, the petitioner is eligible for appointment as an Anganwadi Karyakarti on an honorarium basis, as she is a widow, landless, and falls within the category of below the poverty line. On the other hand, learned Additional Standing Counsel has drawn attention of the Court towards to the petitioner’s representation to the Tehsildar, dated 10.04.2024, wherein petitioner acknowledges that, as per her previous income certificate, her income was shown as Rs. 36,000/- per annum, however, the concerned Area Lekhpal erroneously issued a new
income certificate reflecting her income as Rs. 48,000/- per annum. Learned Additional Standing Counsel further submits that, even considering the petitioner’s own admission, her income as of 07.08.2021 was Rs. 36,000/- per annum, which shows she does not come under the eligibility criteria.
Learned counsel for the petitioner has disputed this contention. Perused the record. In view of the above, without entering into the merits of the case, the petition is disposed of with a direction to the petitioner to submit a fresh representation before respondent no. 4 within ten days from today and if such representation is filed, the same shall be decided by passing a reasoned and speaking order within four weeks thereafter.
