This is an application under Section 482 Cr.P.C. filed for quashing the Criminal Case No. 179 of 2015 (State vs. Aquil Ahmad) pending in the court of Judicial Magistrate Is, Aonla, Bareilly summoning the applicant in case crime no. 276 of 2014 U/s 467 IPC, P.S. Aonla, District Bareilly. 3. This Court on 05.03.2019 proceeded to pass the following: "Learned counsel for the applicants states that the matter has been settled in between the parties and the parties have filed the compromise before the court concerned on 6.9.2018, a copy of the same has been filed as Annexure-5 to the affidavit filed in support of application U/s 482 Cr.P.C. Issue notice to the O.P. No. 2 returnable at an early date. List after service of notice upon O.P. No. 2. " 4. Learned counsel for the applicant has invited the attention of the court towards annexure-5 which starts from page 35 of the paper book reference whereof has been made in para-10 of the affidavit that a compromise has been entered into between the parties on 06.09.2018 which had been filed before the court of Judicial Magistrate-Is Aonla Bareilly. Learned counsel for the applicants submits that direction be issued for verification and in the meantime interim protection be accorded. 4. Learned AGA as well as the counsel appearing for opposite party no.2, has no objection to the same. 5. Considering the said submission, the application stands disposed of directing the applicants to appear before the court below by 13.06.2025 along with the self attested copy of the present application, certified copy of the order. On the receipt of the same, the court below shall make endeavour to put to notice the other party and thereafter verify the compromise application as alleged to have been filed by the applicants within two months. 6. Till the verification is done in the compromise application so submitted by the parties, no coercive action shall be taken against the applicants in Criminal Case No. 179 of 2015 (State vs. Aquil Ahmad) pending in the court of Judicial Magistrate Is, Aonla, Bareilly summoning the applicant in case crime no. 276 of 2014 U/s 467 IPC, P.S. Aonla, District Bareilly. The protection accorded to the applicants is only available subject to compliance of the terms and conditions and timeline as provided herein and in case of default, the order shall stand vacated without reference to the Bench.
