JUSTICE BISWAJIT PALIT Order 07/01/2026 Learned Counsel for the petitioner Mr. Arijit Bhaumik is present. This petition was filed under Section 528 of BNSS, 2023 corresponding to Section 428 of Cr.P.C. seeking direction upon the respondents to unfreeze the petitioner’s bank account 2 bearing No.41977147595 lying with SBI, A.D. Nagar Branch, Agartala. After registration of the case as per order dated 07.11.2025, notices were issued upon all the respondents and as per report of the Registry, it appears that notices were duly served upon all the respondents but none appeared. However, today at the time of hearing Learned Counsel for the petitioner submitted that he has received one communication from the cyber crime PS of the respective State that the bank account of the present petitioner was not involved in any cyber fraud and as such, the concerned PS by a letter dated 12.12.2025 addressing to the State Bank of India urged for unfreezing the account bearing No.41977147595. However, Learned Counsel further submitted that in view of the communication of the cyber crime PS of the respective State no action has yet been taken by the respondent No.6. Since the concerned cyber crime unit of the respective State has given a clean chit in respect of the account of the petitioner so there will be no legal bar on the part of the respondent No.6 to allow the petitioner to operate his bank account lying with them. So, considering all, the present case stands disposed of with a direction to the respondent No.6 to unfreeze the account of the present petitioner lying in the said branch. The present petitioner may submit a copy of this order to the Branch Manager of the respective branch of the State Bank of India for information and doing the needful within a period of 7(seven) days along with a copy of the communication of the respective cyber crime unit of the Police Station. 3 A copy of this order be supplied to Learned Counsel for the petitioner for information.
