Neutral Citation No. - 2025:AHC-LKO:17313-DB Court No. - 2 Case :- WRIT - C No. - 2668 of 2025 Petitioner :- Matsya Jeevi Sahkari Samiti Ltd. Khinjana Barabanki Thru. Mr. Shiv Raj Rawat Respondent :- State Of U.P. Thru. Its Addl. Chief Secy. Fisheries Deptt. Lko. And 3 Others Counsel for Petitioner :- Shalini Gupta,Vineet Jaiswal,Vivek Kumar Verma Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. Learned Standing Counsel has instructions to the effect that the advertisement was issued for settlement of fishery rights in respect of a pond existing on Gata No.724 situated at Village Udhapur, Pargana Kursi, Tehsil Fatehpur, District Barabanki, however, on inquiry it was found that the land is uneven and not fit for fishery rights, therefore, no further action has been taken. The petitioner, however, says that the land is recorded as pond and he is ready to dig a pond on it, which should have been existing as per the record. This is hardly a matter to be looked under Article 226 of the Constitution of India. The petitioner may approach the District Magistrate/Collector, Barabanki or the Sub Divisional Magistrate concerned with his offer, if otherwise maintainable in law, which may be looked into. The Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 26.3.2025 Saurabh Digitally signed by :- SAURABH VERMA High Court of Judicature at Allahabad, Lucknow Bench
