This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘BNSS’), has been filed by the Petitioner/A.1, seeking anticipatory bail, in connection with Crime No.112 of 2024 of Yemmiganur Town Police Station, Kurnool District. 2. A case has been registered against the Petitioner/A.1 and others for the offences punishable under Section 323, 324, 307 r/w. 34 of Indian Penal Code, 1860 (for short, ‘IPC’). 3. The prosecution’s case, in brief, is that on the intervening night of 20/21.06.2024 at about 2.30 A.M at Nagireddy Petrol Bunk, A.1 to A.6 came 2 there in a car armed with knives and attacked the defacto complainant and Razak and when they tried to escape, A.1 stabbed Razak with a knife below the left ribs and caused bleeding injury and when the defacto complainant intervened. A.2 stabbed the defacto complainant with a knife below his stomach and caused bleeding injury and against when A.1 and A.3 tried to stab him with knives, he escaped from them and then all the accused beat the defacto complainant and two others and caused bleeding injuries and thumb injuries and in the meantime when the passerby came there, the accused went away from there and later the injured were shifted to Government Hosiptal, Yemmiganur, and from there the defacto complainant and Razak were referred to Government General Hospital, Kurnool for better treatment. On the complaint given by the defacto complainant, the present case has been registered. 4. Learned counsel for the petitioner/A.1 contends that the petitioner did not participate in the commission of the offence and requested to enlarge the petitioner on bail. He further submits that the other accused in this crime were granted regular bail. He further submits that the petitioner also suffered an injury in a road accident and his eye sight is blurred and was advised to take treatment. 5. Learned Assistant Public Prosecutor, for the Respondent-State opposed the grant of bail to the petitioner/A.1 on the ground that specific accusations have been made against the petitioner herein. 6. I have heard both sides. 7. To appreciate the said submissions made, I have gone through the report lodged by the defacto complainant and other material on record. Learned Assistant Public Prosecutor has also placed the Wound Certificate relating to L.W.1-Mulla Razak, which shows that L.W.1 sustained grievous injuries. The petitioner/A.1 herein alleged to have stabbed L.W.1 with a knife. 3 8. Considering the serious nature of accusations levelled against the petitioner/A.1 and there is a prima-facie case which supported by the Wound Certificate, as produced by the Prosecution, this Court is not inclined to grant anticipatory bail to the petitioner/A.1. 9. Accordingly, the Criminal Petition is dismissed. However, it is open to the petitioner/A.1 to surrender before the Court concerned to work out his remedies in accordance with law.
