The present application under Section 529 B.N.S.S. / old Section 483 Cr.P.C. has been preferred to expedite the proceedings of Misc. Case No.312/2021; Dr. Ram Darash Yadav vs. Dr. Upendra Singh Tomar, U/s 340 Cr.P.C., P.S. Kotwali Nagar, Ayodhya, pending in the Court of CJM, Ayodhya Lucknow. Learned counsel for the applicant has submitted that Respondent No.2 had moved an application under Section 156(3) Cr.P.C. in pursuance of the order passed by the Magistrate concerned an F.I.R. dated 16.02.2021 was registered being Case Crime No.0104/2021 U/s 409, 419, 420, 467, 468, 471, 504 & 506 I.P.C., Police Station - Kotwali Nagar. In the said case the final report was submitted by the police on 18.07.2021. When the applicant came to know about the same, he had moved an application under Section 340 Cr.P.C. on 12.02.2021 on which notice was issued to Respondent No.2, but thereafter no date has ever been fixed and the application moved by the applicant under Section 340 Cr.P.C. is still pending. On being asked from the learned counsel for the applicant whether any application for listing / early disposal of the application filed under Section 340 Cr.P.C. by the applicant has ever been moved or not, the learned counsel for the applicant has replied that it is not in his knowledge whether any such application was ever moved since 2021 or not. After hearing learned counsel for the applicant and learned A.G.A., the present application moved under Section 529 BNSS is disposed of with liberty to the applicant to move appropriate application for early disposal of Misc. Case No.312/2021; Dr. Ram Darash Yadav vs. Dr. Upendra Singh Tomar, U/s 340 Cr.P.C., P.S. Kotwali Nagar, Ayodhya, pending in the Court of CJM, Ayodhya Lucknow. In case any such application is filed, it is expected that the court concerned shall decide the same expeditiously, without granting any unnecessary adjournment to either of the parties.
