Hanifur Rahman @ Hanif who has filed this application under Section 483 of the B.N.S.S, 2023 with prayer for bail as he has been shown as arrested on 13.05.2025 in connection with Basistha P.S Case No. 211/2025 under Section 318(4) of the B.N.S, 2023. Page No.# 2/2 The allegation against the petitioner is that he has swapped the ATM Card of Sri. Gunakanata Khataniar at Guwahati on 17.03.2025. Later, the victim the informant Sri. Gunakanata Khataniar noticed some unauthorized transactions from his saving account No. 11710011877 and then realized that his ATM Card was swapped by the petitioner. Heard Mr. P Borthakur, learned Additional Public Prosecutor, Assam. Mr. P Borthakur, learned Additional Public Prosecutor, Assam has raised serious objections stating that there are incriminating materials in the Case Diary against the petitioner. The petitioner is a history-sheeter in similar offences. He was arrested in 14 cases. I have also scrutinized the Case Diary. Indeed, there are incriminating materials in the Case Dairy against the petitioner and investigation is still under progress.
