The petitioner seeks restitution with regard to possession of the land, which is subject matter of Regular Suit No.370 of 2023, which is pending before learned Civil Judge, Senior Division, Shrawasti. Temporary Injunction application of the petitioner has already been rejected, against which, a miscellaneous appeal has been filed. If the police authorities have illegally interfered in the possession, the petitioner should approach the Superintendent of Police, Shrawasti alongwith requisite proof, who may get an inquiry conducted in the matter to ascertain the truth and if he finds that possession has been interfered illegally by the police authorities, then he shall do the needful. The action, if any, taken shall be communicated to the petitioner. We, however, make it clear that we have not adjudicated the veracity of the allegations made by the petitioner, which shall be done in such inquiry. If still aggrieved, the petitioner may avail other remedies as may be prescribed in law. The Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.)
