This criminal misc. application is filed under Section 528 of B.N.S.S. by the petitioner/accused for quashing of the charge-sheet dated 28.03.2022, summoning/cognizance order dated 10.08.2022 as well as the entire proceedings of Criminal Case No. 5716 of 2022 (Case Crime No. 281 of 2021), titled as “State vs. Kamal Singh Dhami” pending in the court of 2nd Additional Chief Judicial Magistrate, District Dehradun under Section 420 of IPC, P.S. Cantt, District Dehradun qua the petitioner/accused, in view of the compromise arrived at between the parties. 2. In view of the fact that a Compounding 2025:UHC:2226 2 Application was filed by the parties before this Court, this Court vide order dated 06.12.2024 had directed the parties to appear before the Secretary, District Legal Services Authority, District Dehradun in order to get their statements recorded and to verify the compromise deed. 3. Pursuant to such order, Secretary, District Legal Services Authority, District Dehradun has submitted her report dated 13.12.2024 which clearly indicates that the parties have settled the dispute amicably and have also verified the contents of the compromise. 4. In view of the above, Compounding Application (IA No.1 of 2024) is allowed. As a consequence thereof, the charge-sheet dated 28.03.2022, summoning/cognizance order dated 10.08.2022 as well as the entire proceedings of Criminal Case No. 5716 of 2022 (Case Crime No. 281 of 2021), titled as “State vs. Kamal Singh Dhami” pending in the court of 2nd Additional Chief Judicial Magistrate, District Dehradun under Section 420 of IPC, P.S.
