By means of this writ petition, the petitioner has, inter alia, prayed for quashing of the order/office communication dated 17.02.2024, by which the authorities concerned have, under the directions of Gram Pradhan and Ex Secretary, deleted the name of the petitioner from the list of beneficiaries under Pradhan Mantri Avas Yojana (Rural). Heard. The petitioner has not been found to be eligible for extension of the benefit under the Pradhan Mantri Avas Yojana. Reasons for the same have been given in the inquiry report, copy of which has been annexed by the petitioner himself. It is stated therein that Sri Bechan, father of the petitioner, has five children- Ramtej, Shyamu, Upendra, Suneel and Naan. Naan is unmarried. Shyamu already has a house under the Pradhan Mantri Avas Yojana given to him in 2023-24, Ramtej, i.e. the petitioner before us, has one pucca kamra and one kuchcha kamra, Khaprail House. They have five motorcycles and one atta chakki, therefore, they are ineligible. These are factual issues raised by the petitioner, which cannot be seen under Article 226 of the Constitution of India.
