Neutral Citation No. - 2025:AHC-LKO:20371-DB Court No. - 2 Case :- WRIT - C No. - 2716 of 2025 Petitioner :- Smt. Usha Pandey Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko And 7 Others Counsel for Petitioner :- Desh Deepak Singh,Sachin Tulsi,Shagun Srivastava Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. 1. Heard. 2. Petitioner seeks disposal of an application by opposite party nos.1 to 4. Copy of the application is Annexure no.1. We have gone through the application. The applications refers to some false affidavit submitted on her behalf or on her name by some of her family members in definite proceedings before civil court, board of revenue etc pertaining to certain land over which petitioner claims rights. 3. We fail to understand as to under which provision of law the opposite party nos.1 to 4 could conduct such inquiry or investigation. If a criminal offence is made out then the remedy lies under the criminal law and if civil action is required then it has to be taken under the civil law. Such omnibus application that too without reference to any provision of law cannot persuade us to issue any such direction for its disposal. It is not a statutory representation. Without prejudice to the rights, if any, of the petitioner, we find no reason to proceed any further to grant the relief prayed for. Petitioner is at liberty to pursue the remedies as may be prescribed in law. No details of the cases as alleged have been given in the application. Our order shall, however, not come in the way if the Board of Revenue has already instituted some inquiry pertaining to such allegations relating to incident which may have occurred before any revenue court. 4. Accordingly, the petition is disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 10.4.2025 Shanu/- Digitally signed by :- SHANU SUMAN High Court of Judicature at Allahabad, Lucknow Bench
