Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioner was arraigned as Accused in Crime No.188 of 2024of Bhattiprole Police Station, Bapatla District, registered for the alleged offences under Sections 196(1), 352 of the Bharatiya Nyaya Sanhita 2023 and Section 67 of the Information Technology Act 2000-2008. 3. The learned counsel for the petitioner submits that the petitioner was falsely implicated in the complaint. It is alleged in the complaint that the petitioner posted defamatory content on the social media platform against the political leaders. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Bhattiprole Police Station, Bapatla District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the purpose of investigation in connection with Crime No.188 of 2024. -3- CRL.P. No.3271 of 2025 5. Accordingly, the criminal petition is disposed off. 6. Miscellaneous petitions, if any, pending in the criminal petition shall stand closed. ____________________ JUSTICE HARINATH.
