Neutral Citation No. - 2025:AHC-LKO:16235 Court No. - 18 Case :- WRIT - A No. - 2984 of 2025 Petitioner :- Ambarish Kumar Respondent :- State Of U.P. Thru. Secy. Social Welfare Lko And 3 Others Counsel for Petitioner :- Durgendra Kumar Tiwari Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Contention of learned counsel for the petitioner is that respondent no.4 got the appointment on compassionate grounds on account of death of the father of the petitioner. It is stated that while getting appointment, respondent no.4 had given the undertaking to take care of the petitioner who are old, however, he has refused to do so. Considering the allegations levelled in the writ petition and the fact that compassionate appointment is for the benefit of the legal heirs, the petitioner would be at liberty to approach respondent no.2 by filing an application who shall pass requisite orders considering the hardship of the petitioner and would be entitled to recall the compassionate appointment, if the situation so arises. In case the application is filed, respondent no.2 shall pass necessary order in accordance with law within a period of three months. The writ petition is accordingly disposed off.
