The writ petition-SWP No. 1022/2014 preferred by three petitioners wherein they came seeking relief for regularization of their service in the Department of Public Health Engineering (Jal Shakti), Jammu, was pending on the docket of this Court from 2014 onwards only to suffer dismissal for non-prosecution in terms of order dated 07.07.2025 by which time the jurisdiction to adjudicate service related writ petitions came to be vested in the Central Administrative Tribunal (CAT), Jammu Bench to the exclusion of the High Court. Serial Nos. 10 & 11 Regular List 2 CM No. 1736/2026 & CM No. 1737/2026 In SWP No. 1022/2014 02. The petitioners are seeking restoration of said writ petition and then transfer of the same to the Central Administrative Tribunal (CAT), Jammu Bench for adjudication. 03. Instead of doing this exercise, this Court accords liberty to the petitioners to approach the Central Administrative Tribunal (CAT), Jammu Bench within a period of 30 days from the date of passing of this order with an Original Application (O.A.) for the purpose of seeking the reliefs as intended and sought in the writ petition-SWP No. 1022/2014. Time spent all along during the pendency of the writ petition with effect from 05.04.2014 till the passing of this order shall not be counted against the petitioners’ Original Application (O.A.) getting filed before the Central Administrative Tribunal (CAT), Jammu Bench. 04. Petitioners to annex a certified copy of the present writ petition along with a certified copy of this order for the notice and perusal of the Central Administrative Tribunal (CAT), Jammu Bench along with their Original Application (O.A.) 05.
