Dubey, A.P.P. …..... 05/24.06.2025: This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for the offence punishable under Sections 126(2), 115(2), 117(2), 109 and 351(2) BNS 2023 in connection with Jirwabari P.S. Case No. 19/2025, pending in the Court of learned CJM, Sahibganj. Heard the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. There is allegation that this petitioner has assaulted his uncle. After going through the record and after hearing the parties, I find that the petitioner has assaulted his uncle on a trivial issue and the injury is grievous in nature. In view of the aforesaid facts, this is not a fit case to grant anticipatory bail to the petitioner. Accordingly, the same is dismissed. However, the petitioner should appear before the Court and take his defence which will be considered independently without being prejudiced by the order of this Court. Anu/-C.P.-3 (ANANDA SEN, J.)
