The petitioner- Abhishek Kumar @ Chootu is in custody since 28.04.2022 in connection with Thethai Tangar P.S. Case No. 23 of 2022 for the offence registered under Sections 395, 411 of the IPC pending in the Court of learned Principal Sessions Judge, Simdega. Earlier bail application of the petitioner was rejected twice on merit vide order dated 18.04.2023 passed in B.A. No. 224 of 2023 and vide order dated 16.02.2024 passed in B.A. No. 11483 of 2023 by this Court and the same is being renewed on the ground that the petitioner is in custody since 28.04.2022. It is submitted by the learned counsel on behalf of petitioner that a report was earlier called for from the learned Trial Court from which it appears that the case is pending at the stage of defence evidence. Learned A.P.P. opposed the prayer for bail. Considering that matter which is at the penultimate stage of trial, the prayer for bail of the petitioner, is hereby, rejected.
