Learned counsel for the respondents has placed on record office instructions dated 16.07.2025 from the Executive Director of the respondents-Corporation, which reads as under:-
“In this context it is inform that in compliance of the orders passed by the Hon'ble High Court in CWP No. 537 of 2024 DCRG and Leave encashment has already paid lo the petitioners. Thereafter, in compliance of the orders passed by the Hon'ble High Court in Ex. Pet. No. 1289 of 2024 entire due and admissible amount of Dearness Relief has been paid to the petitioner as per decision taken by the Corporation in term of office memorandums issued by the State Govt. and as adopted by the Board of Directors of the Corporation. It is further humbly submitted that as far as the payment of arrears after the year 2016 are concerned, the same shall be disbursed to the petitioners and all similarly situated pensioners as per the decision of the Board of Directors of the Corporation. Hence, full payment on account of due and admissible arrears of DA up to 31.12.2016 has been made to the petitioners vide dated 23.04.2025 as per decisions of Board of directors of the Corporation (Copy enclosed).”
Learned counsel for the petitioner acknowledges the factual assertions made in the afore-extracted instructions and submits that the present application be
disposed of, however, liberty be reserved to the petitioners to seek appropriate remedy in accordance with law for redressal of their surviving grievances, if any.
Accordingly, the application is disposed of, granting liberty as prayed for.
